Opinion by JUDGE SMITH Paul R. Mattingly appeals the trial court's judgment affirming the Department of Revenue's (department) revocation of his driver's license pursuant to the express consent law. Sections 42-2-122.1(1)(a) and 42-2-103(3)(c), C.R.S. (1984 Repl. Vol. 17). We affirm the trial court's decision. On July 3, 1983, Mattingly was charged with driving while under the influence after refusing to submit to a chemical test for blood alcohol content. The arresting officer prepared and served Mattingly with a notice of revocation or denial which included a provision for requesting a hearing. Mattingly thereafter requested an administrative hearing pursuant to $42-2-122.1(7)(a), C.R.S. (1984 Repl. Vol. 17).
